(A) A mandatory fee of $5 is hereby established and assessed pursuant to 55 ILCS 5-1101(f) and the assessments collected by the Circuit Clerk pursuant to statute and this resolution shall be deposited into an account maintained by the County Treasurer specifically for the operation and administration of the Drug Court.
(B) The Circuit Clerk shall collect the fees to the Drug Court Program monthly, less 5%, which is to be retained into the Circuit Clerk Operation and Administrative Fund.
(C) The fees collected are to be paid as follows:
(1) A fee of up to $5 paid by the defendant of a judgment of guilty or grant of supervision for violation of the State Vehicle Code or violations of similar provisions contained in county or municipal ordinances committed in the county that require a court appearance; and
(2) A fee of up to $5 paid by the defendant on a judgment of guilty or grant of supervision under § 5-9-1 of the Unified Code of Corrections for a felony, for a Class A, Class B or Class C misdemeanor, for a petty offense and for a business offense that requires a court appearance.
(D) The effective date of the resolution from which the provisions of this section derive shall be April 15, 2012.
