§ 31.064  DISCIPLINE.
   (A)   The Commission shall have no authority in disciplinary matters involving sworn personnel other than to serve as an appeal board from any disciplinary action taken by the County Sheriff. Any sworn officer (excluding probationary employees) who has been suspended, demoted or terminated by action of the County Sheriff may appeal that action to the Commission. The Commission has the authority to affirm, modify or reverse the decision of the County Sheriff. The Commission’s decision shall be in writing and presented to the employee and County Sheriff within five business days of the hearing.
   (B)   The County Sheriff may, prior to suspension or termination, file charges with the Commission for a hearing prior to disciplinary action. Upon filing such charges, the County Sheriff may suspend the sworn employee pending the decision of the Commission on the charges.
   (C)   The Commission shall set forth its hearing procedures in its rules and regulations.
