§ 112.20  GENERALLY.
   (A)   The County Board hereby adopts and incorporates the provisions of the Illinois Food Handling Regulation Enforcement Act (410 ILCS 625/1 et seq.), as amended.
   (B)   Home kitchen operations, as defined by the Illinois Food Handling and Enforcement Act, as amended, are permitted within the county, provided all requirements of the Illinois Food Handling Regulation and Enforcement Act and other provisions of this section are complied with by the producers and sellers of said products.
   (C)   Home kitchen operations which propose to produce any non-potentially hazardous foods for sale, as defined by the Illinois Food Handling and Enforcement Act, shall be registered with the Franklin-Williamson Bi-County Health Department; shall meet the requirements of Franklin Williamson Bi-County Health Department for training in the safe handling of food products for home kitchens; and shall comply with all regulations and guidelines for the safe handling of food. Monthly gross sales from any home kitchen operation may not exceed $1,000. A written notice shall be provided to each purchaser as follows:
      “This product was produced in a home kitchen not subject to public health inspection and may also possess common food allergens”
   (D)   The Franklin-Williamson Bi-County Health Department is appointed by the County Board to oversee the operations of home kitchen operations as defined herein and to adopt procedures for the registration, training, and operation of home kitchens in the county. The Franklin-Williamson Bi-County shall inspect any home kitchen operation in the event of a complaint or disease outbreak and may, at Franklin-Williamson Bi-County Health Department’s discretion, issue binding orders upon any Home kitchen operation to: comply with safe food handling requirements; modify home kitchen practices; suspend or terminate the home kitchen operation; as deemed to be in the public health and welfare.
