The Fiscal Court shall give consideration to adopt an orphan road; provided that, more than 55% of the property owners on the roadway have petitioned the Court to adopt an orphan road into the county road system and more than 55% of the property owners abutting the roadway have signed a petition stating that they are willing to dedicate the road for public use.
