The definitions contained in the Cannabis Control Act (ILCS Ch. 720, Act 550, §§ 1 et seq.) and the Illinois Controlled Substance Act (ILCS Ch. 720, Act 570, §§ 1 et seq.) apply to this subchapter.
For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BATH SALTS. Any product whether disbursed as incense, potpourri, plant fertilizers, insect repellants, salts or BATH SALTS, which contain any of the following chemicals:
(1) JSW-018, JWG-200, JWH-073, CP-47, 497, Cannabicyclohexanol, 3.4 Methylenedioxyprovalerone (MDPV), Methylone, Mephedrone, 4-Methoxymethcathinone, 4-Fluoromethcathinone, and 3-Fluromethcathinone;
(2) Synthetic derivatives of cathinone and cathinone substitutes, including pentedrone;
(3) Any other non-prescription substance, regardless of form, that has a chemical substance and/or pharmacological effect similar to that derived from the effect intended to be delivered from the ingestion of those substances defined in this subchapter; and
(4) Such other definitions given the term under Illinois law.
SYNTHETIC MARIJUANA. Any product or substance, whether described as tobacco, potpourri, herbs, incense, spice, aromatic, or any combination thereof, and intended for the purpose of being smoked or otherwise ingested, which includes one or more of the following hallucinogenic substances:
(1) 1-Pentyl-3-(1-naphthoyl) indole; some trade or other names: JWF-0I8; or
(2) 1-Butyl-3-(l-naphthoyl) indole; some trade or other names: JWH-073; or
(3) 1-[2-(4-morpholinyl) ethyl]-3-(1-naphthoyl) indole; some trade or other names: JWH-200; or
(4) 5-(1,1-dimethylheptyl-2-[(1R,3S)-3-hydroxycyclohexyl]-phenol; some trade or other names: CP-47,497; or
(5) 5-(1,1-dimethylheptyl)-2-[(1R,3S)-3-hydroxycyclohexyl]-phenol (cannabicyclohexanol); some other trade or other names; cannabicyclohexanol; CP-47,497 C8 homologue; or
(6) Any other non-prescription substance that has a chemical structure and/or pharmacological effect substantially similar to the active ingredient of marijuana, or tetrahydrocannabinol (THC); or
(7) Such other definitions given the term under Illinois law.
