§ 153.38 PRIVATE AGREEMENTS.
   In addition to terms contained in an annexation or pre-annexation agreement that allow for the payment of additional fees to a school district, an individual school district may enter into a private agreement with a developer who is subject to the provisions of this chapter. Such private agreement shall place no responsibility or liability upon the village for the enforcement of any of the provisions or terms contained therein. Specifically, in the event of such an agreement, the village shall not enforce the requirement for payment of funds to such individual school district prior to the issuance of a building permit. The school district shall take full responsibility for collection of funds and for monitoring the status of the building permit.
