(A) For the purposes of protecting the health, safety and welfare of the residents of the village; to facilitate minimizing or eradicating certain potentially public endangering conditions; and to authorize the Village Clerk in conjunction with other village representatives to implement the herein, the following procedure is hereby established to effectuate administrative inspections of all buildings, residences, enclosures, commercial and industrial establishments and all other premises situated within the corporate limits of the village.
(B) On written application made under oath by any duly authorized officer, agent or representative of the village, including fire, health, building, plumbing, electrical and sanitation inspectors, liquor commissioner and Village Engineer, setting forth with sufficient particularity the locality requested to be inspected and the cause and reason necessitating said request, the Village Clerk shall forthwith send a request to consent to administrative inspection in a form substantially similar to division (G) of this section, by certified United States mail, postage prepaid, addressed to a named occupant, if known, otherwise “To Occupant.” Within five days from date of mailing, said addressee shall file the signed consent in the office of the Village Clerk.
(C) If the consent is not filed as described in division (B) of this section or if the person making application for the inspection includes a statement to the effect that there are exigent circumstances necessitating immediate inspection, the Village Attorney shall petition the Circuit Court in the appropriate county to issue a search warrant for said premises or area described in the application by filing with the Court, a written complaint of the individual making the original request for inspection under oath or affirmation, which state facts sufficient to show probable cause and describes with particularity the place or area to be inspected and directed for execution by the person specifically named therein.
(D) The search warrant shall be executed within 96 hours of its issuance with a duplicate of same left with any occupant of the premises being inspected, or if no person is available, left in a conspicuous place in the premises.
(E) All necessary and reasonable force may be used to effect entry into any building or property, or part thereof, to effectuate the search warrant.
(F) A warrant may be executed at any time.
(G) Consent to administrative inspection.
