(A) It shall be unlawful to violate any provision of this chapter, any rule or regulation promulgated hereunder, any provision of the Nursing Home Care Act or any rule or regulation promulgated thereunder. Notice and correction of violations shall be consistent with the provisions of the Nursing Home Care Act.
(B) Any person or facility that violates any provision of this Chapter, any rule or regulation promulgated hereunder, the Nursing Home Care Act or any rule or regulation promulgated thereunder shall be subject to a lawsuit seeking an injunction and/or a fine of not less than $250 nor more than $750 per violation. Each day that such violation exists shall constitute a separate and distinct offense. The facility and its administrator shall be jointly and severally liable for any and all violations.
