§ 115.27 REQUIREMENTS FOR THE CHARITABLE ORGANIZATION.
   No charitable organization shall conduct, participate, engage or share in the proceeds of any tag day until it conforms to the following requirements:
   (A)   The charitable organization fully complies with all rules and regulations established in “An act to regulate solicitation and collection of funds for charitable purposes, providing violation thereof, in making appropriation therefore” as it now exists or may hereafter be amended (ILCS Ch. 225, Act 460, §§ 1 et seq.) and that by making an application for tag day such charitable organization specifically acknowledges and represents that it has fully complied with the act.
   (B)   The charitable organization has actually engaged in a charitable purpose for not less than one year prior to the filing of its application. This division does not apply to religious corporations, trusts or organizations established for religious purposes or to other religious agencies or organizations which serve religion by the preservation or religious rights or freedom from prosecution or prejudice by fostering religion.
   (C)   The charitable organization shall be from the village or affiliated with a local chapter or group.
   (D)   The charitable organization shall agree to cooperate and shall cooperate with all of the charitable organizations in promoting efficiency of amounts and charitable work with a view to prevent duplication of effort and waste of funds collected.
   (E) If applicable, the charitable organization may be required to submit to the Village Board of Trustees in connection with any application for tag days a statement showing its receipts and disbursements for one year immediately preceding its application and that any application shall be verified by an officer of the charitable organization.
   (F)   It shall not employ paid solicitors in connection with the tag day. All solicitors shall be 18 years of age or more, unless accompanied by an adult 21 years of age or greater; however, no solicitor on a roadway shall be less than 16 years of age.
   (G)   In connection with its application for tag day, the charitable organization shall submit a certificate of insurance in the amount of not less than $1,000,000 per claim and $2,000,000 per occurrence, indemnifying, and holding the village harmless for negligent acts of the organization’s solicitors resulting in injuries to any person or property during the solicitation which is causally related to an act of ordinary negligence of the soliciting agent and naming the village as additionally insured.
   (H)   In the event that any charitable organization is unable to obtain a permit to solicit in the village for the purpose of collecting tag day revenues, the affected charitable organization may appeal the village’s determination to request their tag day application. Appeal must be made to the Village President within five days of formal written rejection of any tag day application. The ruling of the Village President is final and no further redress will be available.
