§ 113.02 DEFINITIONS.
   For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALCOHOLIC LIQUOR. Spirits, wine, beer, ale and every other liquid or solid containing alcohol, spirits, wine or beer capable of being consumed as a beverage by human beings.
   BAR. A counter over and upon which alcoholic beverages are prepared and where consumers of alcoholic beverages sit or stand to receive and/or consume such beverages.
   CLUB. A not-for-profit corporation organized under the laws of this state solely for the promotion of some common object other than the sale or consumption of alcoholic liquor, and which conforms to the definition of a club in section 2.24 of An Act relating to alcoholic liquors or as the same may be hereafter amended.
   CONGREGATE ELDERLY HOUSING FACILITY. An assisted living facility or independent living facility, but not a long-term care facility or treatment facility, as defined by the village zoning ordinances, as amended from time to time.
   FLOOR AREA. Of the area open to the general public inside a retail establishment, that portion which is designed and used exclusively for the display of merchandise for sale.
   FRANKFORT HISTORICAL DISTRICT. That territory in the village situated within and bounded on the south by Nebraska Street including that parcel situated on the southeast corner of Ash Street and Nebraska Street and bounded on the east by a strip of land 475 feet east of White Street and bounded on the north by Elwood Street running to Smith Street, then at this junction 88 feet north of Elwood Street west some 225 feet and bounded on the west by a line 160 feet west of Hickory Street, all of which is indicated and defined by the Historical District Map of the village.
   FRATERNAL ORGANIZATION. A benevolent, nationally chartered or recognized, not-for-profit corporation of a national scope, such as the Veterans of Foreign Wars (VFW), the American Legion, and the Elks Club.
   LICENSEE. Any person, firm, corporation, partnership or club holding a license under the provisions of this chapter.
   LIVE ENTERTAINMENT. A person acting, singing, playing an instrument or otherwise performing in person for compensation or profit.
   LOCAL LIQUOR CONTROL COMMISSIONER. The Local Liquor Control Commissioner and any committee or agency appointed by the Commissioner to assist with the discharge of the Commissioner’s duties hereunder.
   MICROBREWERY/DISTILLERY/WINERY WITH SAMPLING AREA. A facility in which beer, wine, or other alcoholic beverages are brewed, fermented, or distilled for distribution and off-site consumption and/or limited on site consumption and which possesses the appropriate license from the State of Illinois. Retail sales and on site consumption of products is permitted.
   MOVIE THEATER. A building over 50,000 square feet with at least six rooms, each measuring over 2,000 square feet and outfitted with a screen and projector, that are specifically designed for the purpose of showing motion pictures to the public as the principal business.
   NOT-FOR-PROFIT CORPORATION. A corporation organized under the Illinois Not For Profit Corporation Act for any of the purposes set forth in Article 3, §§ 105/103.05(a) of that Act.
   RESTAURANT. Any public place kept, used, maintained, advertised and held out to the public as a place where meals are served, and where meals are actually served without sleeping accommodations, such space being provided with adequate and sanitary kitchen and dining equipment and capacity and having employed therein a sufficient number of employees to prepare, cook and serve suitable food for its guests.
   SALE. Any transfer, exchange or barter in any manner, or by any means whatsoever, including the transfer of alcoholic liquors by and through the transfer or negotiation of warehouse receipts or certificates, and includes and means all sales made by any person, whether principal, proprietor, agent, servant or employee.
   SELL AT RETAIL and SALE AT RETAIL. Sales for use and consumption and not for resale in any form.
   SERVICE BAR. A counter over and upon which alcoholic liquor is served separating the area within which alcoholic drinks are prepared from the area where a waitress or other employee of the dram shop receives said alcoholic beverages for delivery to customers seated at tables or elsewhere within the dram shop other than the SERVICE BAR.
   TO SELL. To solicit or receive an order for, or keep or expose for sale and to keep with intent to sell.
