§ 152.025 USES AND STRUCTURES PERMITTED IN FLOODWAYS TO BE REGULATED.
   This section applies to proposed development, redevelopment, site modification or building modification within a regulatory floodway. The regulatory floodway for Hickory Creek, Hickory Creek Tributaries 1, 2, 3, A; Jackson Creek, Jackson Creek Tributary 2; and Forked Creek shall be as delineated on the regulatory floodway maps designated by IDNR-OWR according and referenced in § 152.002. Only those uses and structures will be permitted which meet the criteria in this subchapter. All floodway modifications shall be the minimum necessary to accomplish the purpose of the project. Any encroachment, fill, new construction, substantial improvement and other development within the regulatory floodway is prohibited unless it has been demonstrated through hydrologic and hydraulic analyses performed in accordance with standard engineering practice that the proposed encroachment would not result in any increase in flood levels during the occurrence of the base flood discharge. The development shall also meet the requirements of §§ 152.080 through 152.087.
