4-2-5: SALE, DELIVERY, POSSESSION OR PURCHASE OF TOBACCO PRODUCTS, ALTERNATIVE NICOTINE PRODUCTS, OR ELECTRONIC CIGARETTES:

   A.   Unlawful Sale Or Delivery: A person commits unlawful sale or delivery of tobacco products, alternative nicotine products, or electronic cigarettes, as those terms are defined in Section 3-10-6 and 3-10-6.5 of this Code if he or she sells, delivers or gives any tobacco product, alternative nicotine product, or electronic cigarette to any person under twenty-one (21) years of age.

   B.   Unlawful Possession: No person under twenty-one (21) years of age shall purchase, attempt to purchase, or possess any tobacco product, alternative nicotine product, or electronic cigarette as those terms are defined in Section 3-10-6 and 3-10-6.5 of this Code.

   C.   Fines: Fines for violations of this Section 4-2-5 are set forth in Section 1-4-3-1 of this Code. (Ord. 2019-25, 6-25-2019)
