The provision of this Section shall apply generally and uniformly to all development or redevelopment of multi-family, commercial or industrial properties of any size and residential property greater than one acre or subdivision of residential property resulting in the creation of two (2) or more lots within the Village limits, as well as properties newly annexed or undergoing annexation.
A. Application Procedure: Any person requiring the destruction or relocation of trees or woodlands shall submit the following information to the Village Building and Zoning Official:
1. An application containing the name, address and telephone number of the applicant as well as the owner(s) of the property.
2. Location of the subject property including address or legal description and the size of the subject property acreage.
B. Tree Survey And Landscape Plan: The applicant shall submit a tree survey and landscape plan developed by a qualified landscape architect or planner or plantsman acceptable to the Building and Zoning Official drawn at a scale not smaller than one inch equals fifty feet (1" = 50').
Reduced copies or variations may be required by the Building and Zoning Official or Village Board. The survey and/or plan shall comply to the following:
1. Show the acreage of woodland area, the location of woodland(s) and trees three inches (3") in diameter or larger at breast height (DBH) of desirable native species (using both common and botanical names). Show dead trees, dying trees and trees requiring major pruning eight inches (8") in diameter or larger (DBH).
2. Show all existing trees eight inches (8") in diameter or larger measured at breast height (DBH), all natural features, existing and proposed public and private rights of way and easements, proposed landscaping, including such details as the species, varieties, size and quantity of plant materials and indicating those shown on the plan that are proposed to be removed.
3. Have attached a written statement from the landscape architect or planner or plantsman describing the environmental effect of the landscaping on the subdivision and surrounding area. Include setting goals of the plan in the statement, reasons for selections of specific plant materials, and time required for the plan to produce the desired environmental effect. Include how the plan will deal with any special environmental conditions existing on site or to be created by the development.
C. Approval Of Landscape Plan: The landscape plan shall be subject to approval by the Building and Zoning Official and in recommended cases, by the Village Board.
D. Tree Preservation: The developer or owner(s) agree to retain, wherever possible, woodlands and trees in areas of construction, including existing public and private street rights of way and easements. The preservation techniques under Section 9-5-8 of this Chapter shall be followed.
E. Tree And Woodland Compensation:
1. The developer or owner(s) agree to compensate for any trees eight inches (8") in diameter or greater (DBH) and/or a significant number of less caliper trees that are to be removed. The developer or owner(s) agree to replace these trees as donations, including planting, according to the following size schedule:

2. Newly donated trees shall be high quality, regionally grown trees of a minimum 2-inch to 3-inch caliper measured six inches (6") above the burlapped ball, with a single straight stem with no scars, and branching beginning five feet (5') to six feet (6') from the ground. Trees selected shall be from the following varieties:

3. The developer or owner(s) of subdivided property shall also be required to donate and plant trees of the size and variety listed above in subsection B2 in the frontage area of every lot and parcel in the development. The drip line of the tree when mature, shall not exceed the property lines of adjacent neighboring properties. The following donation ratio shall apply:

Any variances must be approved by the Building and Zoning Official or recommended for approval by the Village Board. The number of trees for R-4, R-5, unit housing, apartments, commercial, recreational, and industrial properties shall be recommended by the Building and Zoning Official and approved by the Village Board.
