8-4-14: VILLAGE COMMUTER PARKING LOTS:
   A.   Established: There are hereby established certain Village commuter parking lots for residents of the area described in the plats attached to the ordinance codified herein on file in the Village Clerk's Office and which lots shall be collectively designated as the Village commuter parking lots.
   B.   Use Of Lots: Said lots shall be used only by legally and currently licensed vehicles under two and one-half (21/2) tons. No unauthorized vehicle or inoperable or disabled vehicle may be placed in any commuter parking lot. (Ord. 86-46, 12-1-1986)
   C.   Fees: The parking rates for each parking space are hereby established for any one (1) 24-hour parking period between five o'clock (5:00) A.M. on one day to five o'clock (5:00) A.M. of the succeeding day as follows: (Ord. 97-3, 2-3-1997)
      1.   Daily Rate 1 : One dollar fifty cents ($1.50) per day. (Ord. 97-3, 2-3-1997; amd. Ord. 2007-59, 11-14-2007; Ord. 2008-49, 12-9-2008)
      2.   Monthly Rate: Thirty dollars ($30.00) per month. (Ord. 97-3, 2-3-1997; amd. Ord. 2007-59, 11-14-2007; Ord. 2008-49, 12-9-2008; Ord. 2015-33, 7-28-2015)
      3.   Exception: No fee for parking shall be required for the period commencing nine o'clock (9:00) A.M. on Saturday morning through one minute after twelve o'clock (12:01) A.M. Monday morning. (Ord. 97-3, 2-3-1997)
   D.   Violation:
      1.   A parking fee violation exists when:
         a.   There is insufficient money or tokens placed in the parking meter slot for the designated parking space used for a vehicle during said twenty four (24) hour period, or
         b.   There is no current monthly parking sticker plainly hanging from the rearview mirror located above the dashboard. (Ord. 2002-44, 7-9-2002)
      2.   An unauthorized use violation occurs when:
         a.   The parking of any vehicle is such that any part of it occupies more than one parking space or protrudes beyond the space in which its wheels are located, or
         b.   The parking space is used by a vehicle in excess of two and one-half (21/2) tons, or
         c.   The parking space is used by a disabled or nonoperating vehicle at any time, or
         d.   The parking space is used continuously for five (5) successive twenty four (24) hour periods and each twenty four (24) hour period is in fact a parking fee violation. (Ord. 86-46, 12-1-1986)
   E.   Penalty:
      1.   In the event of a parking fee violation, i.e., the parking fee is not paid on a daily basis or in the event the monthly fee is not paid or proof of payment is not exhibited on the rearview mirror of the automobile by a clearly valid sticker, then the registered owner of said vehicle is subject to a fine of twenty five dollars ($25.00). If the twenty five dollar ($25.00) fine is not paid within thirty (30) days after the Village notifies the registered owner of the vehicle, then the fine shall be increased to seventy five dollars ($75.00) and the owner of the vehicle shall be notified of the increase. If the increased amount is not paid within thirty (30) days after notification of the increase, then the Police Department may issue a notice to appear so that the violation will be presented and adjudicated pursuant to the Village's administrative hearing procedures (chapter 7 of this title).       2.   In the event there is an unauthorized use violation of said parking space, then the penalty shall not exceed the sum of five hundred dollars ($500.00) per day.
      3.   In the event any vehicle is in a parking space illegally after one hundred twenty (120) hours, then said vehicle is subject to being towed from the commuter parking lot and impounded and the owner shall be subject to payment of the fee, the impoundment fee and a minimum fine to the Village of not more than five hundred dollars ($500.00) and said vehicle shall not be released until all charges aforesaid are paid.
