8-3-9: SKATEBOARDS:
No person shall operate, ride, ride upon or propel a skateboard in violation of this section.
   A.   Definitions:
   PROPEL: The use of force to move or push forward whether manually or machine powered.
   RIDE: To be carried or travel on a device.
   SKATEBOARD: A device consisting of a board mounted on small wheels used for coasting or performing athletic stunts (manual or powered).
   B.   Public Property Prohibition: It shall be unlawful for any person to operate, ride, ride upon, or propel a skateboard in any of the following public locations:
      1.   Upon any public street, highway, sidewalk, parking lot, or other public property of any kind within the following specifically defined area(s):
The area bounded to the north by the northerly right of way line of Riverview Avenue extended easterly and westerly; to the east by the easterly right of way line of Lakeside Lane extended northerly and southerly; to the south by the southerly right of way line of Cypress Avenue, extended westerly; and to the west by the shoreline of Pistakee Lake, Nippersink Lake and easterly channel which connects said lakes, as depicted on the following map:
      2.   Village parking lots wherever located;
      3.   The surface of any streets or highways located within the village.
The only exception to the above prohibited areas shall be village owned bike trails and designated skateboarding parks.
   C.   Private Property Prohibition: It shall be unlawful for any person to operate, ride, or propel a skateboard upon any portion of private property unless permission has been received from the owner, lessee or person in control of that property.
   D.   Restrictions In Permitted Areas:
      1.   On nonrestricted publicly owned sidewalks and bike trails operators or riders of skateboards shall yield the right of way to other pedestrians and shall not endanger or interfere with normal pedestrian traffic on those sidewalks and bike trails.
      2.   No person shall operate or ride upon a skateboard, rollerblades, roller skates, or any means of any coaster device on any publicly used ancillary structure, including, but not limited to, benches, gazebos, bike racks, handrails, and curb bumpers.
   E.   Parental Responsibility: Any parent, guardian, custodian, or person in control of, or responsible for any child under the age of sixteen (16) who knowingly allows said child to violate the provisions of this section and who has previously been advised of a prior violation or violations of this section by the same child, shall be subject to prosecution under this section and the penalties prescribed for violation of this section.
   F.   Penalties: The penalty for violating this section shall be the payment to the village of Fox Lake of a fine of not less than ten dollars ($10.00) nor more than twenty dollars ($20.00) for the first offense, and not less than twenty five dollars ($25.00) nor more than fifty dollars ($50.00) for the second and repeated offenses.
