7-4-17: INSPECTIONS, ACCESS TO PREMISES:
   A.   The Sewer and Water Supervisor or his designee shall have the right of access to any premises within the Village for purposes of reasonable inspection to ascertain whether such premises are connected to the Village water system, to inspect the plumbing within the building and the number and type of water connections to the combined system, and to inspect the water meter on the premises. Any person refusing the right of the Sewer and Water Supervisor or his designee to access and inspect his premises shall be subject to a penalty of not less than fifty dollars ($50.00) nor more than seven hundred fifty dollars ($750.00) and to an additional penalty of not less than fifty dollars ($50.00) each day such refusal continues to exist.
   B.   Access for inspection or reading of water meters shall be allowed at least six (6) times per year.
   C.   In addition to any other penalties provided herein, the Village shall have the power to physically disconnect the water service to a building and to red tag the building as unfit for human occupancy, if the owner or occupant of such building refuses to allow access for inspection or reading of meters. The procedure to be followed in any such disconnection shall be as follows:
      1.   If access to a building cannot be obtained voluntarily, notice in the following form shall be served personally or sent by certified or registered mail, return receipt requested, to the owner of the building and the occupant of the building (if his name be known) and in addition, a copy of the notice shall be posted on the door of the building. The notice shall be in the following form:
            NOTICE OF REQUIRED ACCESS TO INSPECT WATER METER
You are hereby notified that the sewer & water supervisor or his designee, desires to inspect/repair/replace/read the water meter located on your premises known as                .
You are hereby required to arrange a time for such inspection on a week day between 7:30 a.m. and 3:00 p.m. by calling the office of the sewer & water supervisor at 587-         and arranging for such inspection to be conducted within 30 days of the date of this notice.
Your failure to comply with this notice will result in your water service being disconnected.

      2.   If inspection cannot be reasonably made within thirty (30) days of the mailing or posting of the above notice, then a second notice shall be mailed and posted as aforesaid, said second notice to be in the following form: (Ord. 2010-02, 1-26-2010)
            NOTICE OF TERMINATION
You are hereby notified that water service to your premises at                      will be disconnected on or after the          day of                , 20        , because of your refusal to allow access to the building for the purpose of inspecting and/or reading your water meter.
You may prevent such disconnection by calling the office of the sewer & water supervisor at 587-         and arranging for such inspection to be conducted prior to the disconnection date or by requesting a hearing before the Village Administrator or her designee prior to the disconnection date.
NO FURTHER NOTICES WILL BE SENT TO YOU PRIOR TO DISCONNECTION!

      3.   If a hearing is requested, it shall be conducted by the Village Administrator or her designee. If said Hearing Officer determines the water should be disconnected, then the date of such disconnection shall be furnished to the person requesting the hearing in person, if he attends the hearing or by mail if he fails to attend the hearing, and the Village shall disconnect the water service on or after that date.       4.   If no hearing is requested, then the Village shall disconnect the water service on or after the disconnection date stated in the notice.
      5.   Once water service has been disconnected as provided herein, the following fees plus any amounts due for water use, shall be charged prior to reconnection:
An additional hearing fee of fifty dollars ($50.00) and a two hundred dollar ($200.00) reconnection fee plus any unpaid charges due pursuant to subsection 7-4-8B of this chapter.
   D.   It shall be unlawful for any person to reconnect or turn on any water service which has been disconnected by the village without written approval of the sewer and water supervisor. Any person found guilty of violating this section shall be fined not less than two hundred dollars ($200.00) and not more than seven hundred fifty dollars ($750.00). In addition, when the village is notified that water service has been unlawfully reconnected, the village shall have the power to immediately disconnect such service without notice.
   E.   All costs incurred by the village in disconnecting water service shall be borne by and be the responsibility of the owner of the property served. All such costs shall be paid to the village before service is restored to said property. (Ord. 2010-02, 1-26-2010)
