7-4-14: SERVICE PIPES:
   A.   New Installation: All new service connections and service pipes from the village water main to the property to be served shall be installed by, and at the cost of either the owner or the applicant for said service. Such installation shall be in the presence of and under the supervision of the village building department.
In the event that a water user, after paying any appropriate connection fee, desires to connect his property to an existing service pipe which was already connected to a village main, then the sewer and water supervisor shall evaluate the condition of the existing service pipe, and if determined to be unsatisfactory, the user shall be required to pay the cost to tap a new service pipe into the main. The village agrees to provide suitable materials to the user for the connection from the main to the buffalo box, but all labor and equipment costs shall be borne by the user.    B.   Restoration Of Paved Roadways:
      1.   Backfilling: Where existing roadways or drives have been disturbed by construction, the contractor shall place controlled low strength material, backfill, mix 2 in accordance with section 593 of the latest edition of the Illinois department of transportation (IDOT) "Standard Specifications For Road And Bridge Construction", adopted January 1, 2007, from an elevation of one foot (1') above the pipe up to an elevation four inches (4") below the existing pavement grade. If approved by the village, a temporary driving surface will be provided by filling the remainder of the trench up to the existing surface with CA-6 base course material or an approved equal. Before paving the base course will be graded to the proper elevation for the surfacing material specified.
      2.   Paving: Where existing roadways or drives have been disturbed by construction, the contractor shall restore the roadway in accordance with all applicable portions of division 400 of the latest edition of the Illinois department of transportation (IDOT) "Standard Specifications For Road And Bridge Construction", adopted January 1, 2007. When placing hot mix asphalt (HMA) the contractor shall provide a minimum pavement thickness of four inches (4") consisting of two (2) lifts. The bottom lift shall consist of HMA binder course, IL-19.0, N50 to a compacted lift thickness of two inches (2"). The upper lift shall consist of HMA surface course, mix "C", N50 to a compacted lift thickness of two inches (2"). If the existing pavement thickness is greater than four inches (4") the contractor shall adjust the lift thickness to match existing conditions. (Ord. 2010-02, 1-26-2010; amd.       3.   Excavations: In making excavations in streets or highways for laying service pipe or making repairs, the paving and earth removed must be deposited in a manner that will occasion the least inconvenience to the public. No person shall leave any such excavation made in any street or highway open at any time without barricades, and during the night, warning lights shall be maintained at such excavation.    C.   Specifications: All water service pipes from the main to the meter shall be not less than one inch (1") in size. All pipes, fittings and connections shall be uniform and comply with specifications established by the village board. (Ord. 2010-02, 1-26-2010)
   D.   Repairs: Repairs to the water main, service connection, service pipe to the curb stop and curb stop/buffalo box shall be the responsibility of the village. Repairs to the service pipe connection to the curb stop (from the building) and the service pipe from the curb stop to the building, shall be the responsibility of the building owner or user provided, however, if the buffalo box is damaged by the building owner or user, then the buffalo box shall be repaired by the village at the user's expense. If the curb stop/buffalo box is located on private property, then the owner of such private property grants to the village a license to go upon such private property for purposes of disconnecting or repairing the water service and such license shall be a precondition of any owner or user to connect to or remain connected to the village water service. Nothing contained herein shall be construed to require the village to make repairs of service pipes or curb stops which are located on private property. Furthermore, if there is more than one curb stop for a water service, the village shall only be responsible for repairs to the curb stop closest to the water main. (Ord. 2010-02, 1-26-2010; amd.    E.   User To Repair Frozen Pipes; Deficiencies: All users shall keep their own service pipes in good repair and protected from frost, at their own risk and expense, and shall prevent any unnecessary waste of water. If a service pipe freezes the village is not responsible for any repairs or damages that may occur. In the event that the village becomes aware of deficiencies in the service pipe, the village shall notify the owner of such deficiencies, either in person or in writing. The owner shall have the deficiencies corrected within thirty (30) days after such notice, after which the water supply shall be shut off and shall not be turned on again until such time as the deficiencies are corrected; provided, however, in the event of an emergency as determined by the sewer and water supervisor, the owner shall be notified to make immediate repairs, and if the owner fails or refuses to do so, then the village may make the repairs and the owner shall be responsible for the costs incurred by the village in making such repairs.    F.   Use Restriction: No user shall permit any connection to his service pipe other than a single connection to his unit.
   G.   Village Responsibility: It is expressly stipulated that no claim shall be made against the village by reason of the breaking, clogging, stoppage, or freezing of any service pipe; nor from any damage arising from repairing or maintaining mains, making connections or extensions or any other work that may be deemed necessary by the village's sewer and water department. The right is hereby reserved to cut off the service at any time for the purpose of repairs or any other necessary purpose, any permit granted or regulation to the contrary notwithstanding, provided that, except in emergencies, the sewer and water department will attempt to provide reasonable notice prior to such cutoff.
   H.   Authorized Taps To Main: No persons except those having special permission from the sewer and water department or persons in their service and approved by them, will be permitted, under any circumstances, to tap the water mains or distribution pipes. The kind and size of the connection with the pipe shall be that specified in the permit or order from the sewer and water department.
   I.   Location Of Services And Curb Stops: Water service lines and curb stops shall be located outside of any paved, hard surface driveway approaches or driveway areas where a new water service is installed for all new and existing one- and two-family dwellings. In all new subdivisions, water service lines and curb stops must be utilized in their designed and approved locations. If the water service curb stop falls within the driveway approach or driveway surface, the property owner shall sign a letter of indemnification with the village, holding the village harmless for any and all future liability, loss, or damage associated with any work as may be required by the village within the property owner's paved portion of the driveway which is located in the village road right of way. This letter of indemnification shall be recorded with the recorder of deeds, with the recording fee paid by the property owner. The water service curb stop located within the driveway approach or paved surface shall be isolated with expansion material. (Ord. 2014-01, 1-28-2014)
