7-3-4: BUILDING SEWERS AND CONNECTIONS:
   A.   Connection Or Construction; Permit Required: No unauthorized person shall uncover, make any connections with, or opening into, use, alter, or disturb any public sewer or appurtenance thereof without first obtaining a written permit from the village building department.
   B.   Discharge To Sanitary Sewer: It shall be unlawful to discharge wastewater to any public sanitary sewer except those wastewaters in compliance with standards promulgated pursuant to the federal act or the state act, or any rules, regulations, ordinances or standards of the village.
   C.   Building Sewer Permits, Fees:
      1.   There shall be two (2) separate classes of building sewer permits: for residential or commercial service, and for service to establishments producing industrial wastes. In either case, the owner or his agent shall make application on a special form furnished by the village. The permit application shall be supplemented by any plans, specifications or other information considered pertinent in the judgment of the supervisor of sewer and water. A permit and inspection fee of one hundred dollars ($100.00) for a residential or commercial building sewer permit shall be paid to the village at the time the application is filed. The industry, as a condition of permit authorization, must provide information describing its wastewater constituents, characteristics and type of activity.
      2.   A building sewer permit will only be issued and a sewer connection shall only be allowed if it can be demonstrated that the downstream sewerage works, including sewers, pump stations and wastewater treatment facilities, have sufficient reserve capacity to adequately and efficiently handle the additional anticipated waste load.
   D.   Costs And Expenses; Indemnification: All costs and expenses incident to the installation and connection of the building sewer shall be borne by the owner. The person installing the building sewer for said owner shall be a licensed plumber and he shall indemnify the village from any loss or damage that may directly or indirectly be occasioned by said installation. Before a building sewer permit is issued, the plumber shall file with the village clerk an indemnity bond in the amount of fifty thousand dollars ($50,000.00) with corporate surety licensed to do business in the state, on bond form supplied by the village. In addition thereto, the plumber shall file with the village clerk a certificate of insurance showing the village as an insured and covering public liability insurance in the amount of one million dollars ($1,000,000.00) for bodily injury and one million dollars ($1,000,000.00) for damage to property.
   E.   Separate Facilities Required; Exception: A separate and independent building sewer shall be provided for every building; except where one building stands at the rear of another on an interior lot and no private sewer is available or can be constructed to the rear building through an adjoining alley, court, yard or driveway, the building sewer from the front building may be extended to the rear building and the whole considered as one building sewer, but separate user fees shall be paid for each building.
   F.   Old Building Sewers: Old building sewers may be used in connection with new buildings only when they are found on examination and test by the supervisor of sewer and water to meet all requirements of this chapter.
   G.   Pipes And Excavations: Building sewers shall not be less than six inch (6") diameter size pipe installed at a minimum invert slope of one-eighth inch (1/8") per foot, or not less than four inch (4") diameter size pipe in lengths of not less than ten feet (10') installed at a minimum invert slope of one-fourth inch (1/4") per foot. Building sewers shall be constructed in accordance with the requirements of the supervisor of sewer and water as to trench excavation and backfilling, installation of pipe and fittings and testing.
   H.   Construction Materials: Building sewers shall be constructed using one of the following listed materials:
      1.   PVC sewer pipe and fittings with solvent welded joints or compression type rubber ring gasket joints conforming to the latest revision of ASTM specification D2751 installed in accordance with the manufacturer's recommendations.
      2.   Extra heavy cast iron soil pipe and fittings conforming to the latest revision of CISPI specification HS-67 with compression type rubber ring gasket joints, conforming to the latest revision of ASTM specification C564, installed in accordance with the latest revision of the Illinois state plumbing code.
   I.   Branch Fitting: The connection of the building sewer into the public sewer shall be made at the branch fitting, if such is available at a suitable location. If the public sewer is twelve inches (12") in diameter or less, and no properly located branch fitting is available, the owner shall, at his expense, install a branch fitting in the public sewer at the location specified and installation approved by the supervisor of sewer and water.
   J.   Connection:
      1.   Building Sewers Bedded: All building sewers shall be bedded on a layer of gravel or crushed stone, size #67, conforming to the latest revision of ASTM specification D448, to provide a minimum thickness of four inches (4") under and supporting the full bottom quadrant of the pipe. Backfill materials shall be placed and tamped by hand in six inch (6") layers around the pipe to a height of twelve inches (12") over the top of pipe. (Ord. 2010-01, 1-26-2010)
      2.   Restoration Of Paved Roadways:
         a.   Backfilling: Where existing roadways or drives have been disturbed by construction, the contractor shall place controlled low strength material, backfill, mix 2 in accordance with section 593 of the latest edition of the Illinois department of transportation (IDOT) "Standard Specifications For Road And Bridge Construction", adopted January 1, 2007, from an elevation of one foot (1') above the pipe up to an elevation four inches (4") below the existing pavement grade. If approved by the village, a temporary driving surface will be provided by filling the remainder of the trench up to the existing surface with CA-6 base course material or an approved equal. Before paving the base course will be graded to the proper elevation for the surfacing material specified.
         b.   Paving: Where existing roadways or drives have been disturbed by construction, the contractor shall restore the roadway in accordance with all applicable portions of division 400 of the latest edition of the Illinois department of transportation (IDOT) "Standard Specifications For Road And Bridge Construction", adopted January 1, 2007. When placing hot mix asphalt (HMA) the contractor shall provide a minimum pavement thickness of four inches (4") consisting of two (2) lifts. The bottom lift shall consist of HMA binder course, IL-19.0, N50 to a compacted lift thickness of two inches (2"). The upper lift shall consist of HMA surface course, mix "C", N50 to a compacted lift thickness of two inches (2"). If the existing pavement thickness is greater than four inches (4") the contractor shall adjust the lift thickness to match existing conditions. (Ord. 2010-01, 1-26-2010; amd.       3.   Building Sewer Elevation: Whenever possible, the building sewer shall be brought to the building at an elevation below the basement floor. No building sewer shall be laid parallel to or within three feet (3') of any bearing wall which might thereby be weakened. The depth shall be sufficient to afford protection from frost. In all buildings in which any building drain is too low to permit gravity flow to the public sewer, sewage carried by such drains shall be lifted by approved pumping devices and discharged to the building sewer.
      4.   Check Valve Installed: In areas designated floodplain or flood area, a check valve shall be installed on the sewer line to prevent backup of sewage during high water conditions.
   K.   Prohibited Drainages: No person shall make connection of roof downspouts, exterior foundation drains, areaway drains, or other sources of surface runoff or groundwater to a building sewer or building drain which in turn is connected directly or indirectly to a public sanitary sewer.
   L.   Inspection; Final Connection: The applicant for the building sewer permit shall notify the building department twenty four (24) hours in advance when the building sewer is ready for inspection and connection to the public sewer. The connection shall be made under the supervision of the supervisor of sewer and water or his representative.
   M.   Guarding Excavations; Restoration: All excavations for building sewer installation shall be adequately guarded with barricades and lights so as to protect the public from hazard. Streets, sidewalks, parkways and other property disturbed in the course of the work shall be restored in a manner satisfactory to the village. Prior to any excavation, the plumber or sewer contractor shall notify all public and private utility companies.
   N.   Repair And Maintenance Services: All repair service and maintenance service on a property's sewer service pipe between the sewer user's property line and the building shall be made by and at the expense of the owner of the property. All repair service and maintenance service on a property's sewer service pipe between the sewer main and the sewer user's property line shall be made by and at the expense of the village; provided, however, where damage to the service pipe for which the village is responsible occurs as a result of negligence or wilful acts of the property owner or occupant, then the party causing the damage shall be responsible for the cost of repair. The village may, in case of emergency, repair any property sewer service pipe, at the expense of the owner of the property served. (Ord. 2010-01, 1-26-2010)
   O.   Village Responsibility: It is expressly stipulated that no claim shall be made against the village by reason of the breaking, clogging, stoppage, or freezing of any service pipe; nor from any damage arising from repairing or maintaining sewers, making connections or extensions or any other work that may be deemed necessary by the village's water and sewer department. The right is hereby reserved to cut off the service at any time for the purpose of repairs or any other necessary purpose, any permit granted or regulation to the contrary notwithstanding, provided that, except in emergencies, the water and sewer department will attempt to provide reasonable notice prior to such cutoff.
   P.   Deficiencies In Service Pipe: In the event that the village becomes aware of deficiencies in the service pipe, the village shall notify the owner of such deficiencies, either in person or in writing. The owner shall have the deficiencies corrected within thirty (30) days after such notice, after which the water supply shall be shut off and shall not be turned on again until such time as the deficiencies are corrected; provided, however, in the event of an emergency as determined by the sewer and water supervisor, the owner shall be notified to make immediate repairs, and if the owner fails or refuses to do so, then the village may make the repairs and the owner shall be responsible for the costs incurred by the village in making such repairs.
