7-3-3: PRIVATE SEWAGE DISPOSAL:
   A.   Where a public sanitary sewer is not available under the provisions of subsection 7-3-2D of this chapter, the building sewer shall be connected to a private sewage disposal system complying with the provisions of this section.
   B.   Before commencement of construction of a private sewage disposal system, the owner shall first obtain a written permit therefor signed by either the Lake County health department or the McHenry County health department, depending on the location of the premises.
   C.   No occupancy permit for a structure serviced by a private sewage disposal system shall be issued until the private sewage disposal system has been completed and approved in writing by the Lake County health department or the McHenry County health department, depending on the location of the premises.
   D.   The type, capacities, location and layout of a private sewage disposal system shall comply with all recommendations of the state of Illinois private sewage disposal licensing act and code and with the state of Illinois environmental protection agency. No permit shall be issued for any private sewage disposal system employing subsurface soil absorption facilities where the area of the lot is less than fifteen thousand (15,000) square feet (1,394 m2). No septic tank or cesspool shall be permitted to discharge to any natural outlet or watercourse.
   E.   The owner shall operate and maintain the private sewage disposal facilities in a sanitary manner at all times, and at no expense to the village.
   F.   At such time as a public sanitary sewer becomes available to a property served by a private sewage disposal system, as provided in subsection 7-3-2D of this chapter, the building sewer shall be connected to said sewer within ninety (90) days and the private sewage disposal system shall be cleaned of sludge and filled with sand or gravel.
   G.   No statement contained in this section shall be construed to interfere with any additional requirements that may be imposed by the building or zoning authority having jurisdiction over said property. (Ord. 2010-01, 1-26-2010)
