5-3-1: FEE:
   A.   Statute Authority: The Village may levy such taxes as are permitted by 65 Illinois Compiled Statutes 5/11-19-4 as heretofore and hereinafter amended, to pay the cost of collection or disposal of garbage. Said tax shall be in addition to the amounts levied for general purposes as provided by 65 Illinois Compiled Statutes 5/11-19-4. (Ord. 2002-33, 6-11-2002)
   B.   Service Charge:
      1.   Service Charge Established:
         a.   Pursuant to 65 Illinois Compiled Statutes 5/11-19-4 and 5/11-19-5, the Corporate Authorities of this Village are authorized to finance the establishment and maintenance of systems or plants, by contract or by direct provision, for the collection and disposal, treatment or recycling of garbage, refuse and ashes by service charges to be collected from persons receiving service, and are further authorized to provide for an exclusive method for the disposition of garbage, refuse and ashes within the Village.          b.   In order to establish service charges which can reasonably be expected to yield revenues not in excess of contract obligations and the costs of operation, maintenance, and an adequate Depreciation Fund for the collection and disposal of garbage, refuse and ashes, it is necessary to assess a service charge of sixteen dollars fifty six cents ($16.56) per month for all single-family residential units and multi-family residential units with curbside individual container service plus a sixty two cent ($0.62) per month administrative fee; and sixteen dollars twenty four cents ($16.24) per unit per month for all other multi-family residential units plus a sixty two cent ($0.62) per month administrative fee, to be billed at regular intervals for all persons receiving service as aforesaid, effective until billing dates beginning November 1, 2019. Thereafter service charges shall be increased by two and one-half percent (21/2%) per year in accordance with the Village's contract for garbage collection. (Ord. 2017-32, 7-11-2017)
         c.   In order to enable the Village to avail itself of bargaining power in negotiating contracts for garbage removal on behalf of its residents, the Village hereby ordains that the exclusive method for disposition of garbage, refuse and ashes available to residents of the Village shall be through the garbage hauler with whom the Village has a pending contract from time to time.       2.   Payment Of Bills; Delinquencies: Except as hereinafter provided, from and after the effective date of this chapter, all persons receiving service for the collection and disposal of garbage, refuse and ashes within the corporate limits of the Village shall pay a monthly charge to the Village as set forth in subsection B1b of this section, said charge to be billed on a bimonthly basis (every 2 months).
Such bills shall be deemed delinquent if not paid within thirty (30) days of billing date and an additional ten percent (10%) shall be added to such delinquent balance. In the event the bill for collection and disposal of garbage, refuse and ashes, including any delinquency charge then due is not paid within sixty (60) days after the billing date, then an additional ten percent (10%) delinquency charge shall be added to the delinquent balance.
If, after written notice from the Village that a charge is delinquent, a user fails to make payment of such charge and delinquency charge within ten (10) days thereafter, the Corporate Authorities may undertake such legal proceedings as are required to enforce collection, in which event such user shall also reimburse the Village for all costs, sheriff fees, attorney fees and other expenses as are incurred to enforce collection as aforesaid.       3.   Service Charge Schedule: Each customer benefiting from the collection and disposal of garbage, refuse and ashes within the corporate limits of the Village and subject to the monthly service charge, shall be furnished a schedule evidencing the establishment of the service charge, prior to the collection of any such service charge.
