5-2-1: PROHIBITED; EXCEPTIONS:
   A.   It shall be unlawful to discharge from any stacks, chimneys, exhausts, vents, ducts, openings, buildings, structures, premises, open fires, portable boilers, vehicles, processes or any other source any smoke, soot, fly ash, dust, cinders, dirt, noxious or obnoxious acids, fumes, oxides, gases, vapors, odors, toxic or radioactive substances, waste, particulate, solid, liquid or gaseous matter; or any other materials in such place, manner or concentration as to cause injury, detriment, nuisance, or annoyance to the public; or to endanger the health, comfort, repose, safety or welfare of the public; or in such a manner as to cause or to have a natural tendency to cause injury or damage to business or property; provided, however, leaves may be burned on private property between the period of April 1 to June 1 and September 1 to December 1, of each and every year, provided, however, burning of leaves on private property shall not be allowed from April 14, 2020, through June 1, 2020.
   B.   The student body may have their annual homecoming bonfire by special permit to be issued by the chief of the fire department, and under his supervision.
   C.   The burning of diseased elm trees or dead elm wood pursuant to subsections 5-4-1C and 5-4-4A of this title are hereby declared as exceptions hereunder. (Ord. 89-22, 2-6-1989; amd. Ord. 2020-12, 4-14-2020)
