(a) While operating a USV on the streets within the City, any owner or operator shall comply with any and all laws pertaining to motor vehicles including, without limitation, safety requirements and insurance requirements.
(b) While a USV is being operated on the streets of the City, it shall at all times be in compliance with the requirements of the USV Inspection sheet.
(c) No person shall operate a USV upon any street in the City where the posted speed limits is greater than twenty-five (25) miles per hour. However, USV(s) will be permitted to cross intersections with higher speeds, as long as they remain on a street that has a speed limit of twenty-five (25) mph or less.
(d) Lap belts shall be professionally installed and available with respect to each seating position located on a USV.
(e) Any child who falls under the child restraint criteria set by Ohio R.C. 4511.81, or successor related provisions, is prohibited from being a passenger in a golf cart operated on any City street, right of way or public area in the City of Fosteria. This includes children who are up to four years old and less than forty (40) pounds who are required to be in a child safety seat or any child who is eight (8) years older or less and under four feet nine inches (4'9") in height who is required to be in a booster seat.
(f) The person(s) operating a USV must have a valid operator’s license and show proof of insurance on the USV while on the public streets of the City.
(g) No USV shall be operated on any sidewalk except to cross the sidewalk.
(h) USV(s) are considered seasonal vehicles. Due to the possibility of an accident, the use of such vehicles will be strictly prohibited from operation when the roadways are snow or ice covered.
(i) Operators of USV(s) must follow all motor vehicle laws. USV(s) and operators not complying with the Ohio Revised Code (ORC) and the Code of Federal Regulations (CFR) subject themselves to citation and/or impoundment at their expense.
(j) The City has implemented this ordinance in conjunction with the ORC and OAC.
