EDITOR’S NOTE: Pursuant to Ordinance 2016-12 this section is fully ratified by Council for the years 2013 - 2015.
Council hereby authorizes the sale of personal property including motor vehicles acquired for the use of municipal officers and departments, and road machinery, equipment, tools, or supplies, which are not needed for public use, or are obsolete or unfit for the use for which it was acquired, by internet auction in the following manner:
(a) Property to be auctioned via the internet must be approved for auction by ordinance through the Safety Service Director and in accordance with the Fixed Asset Policy;
(b) Property to be auctioned via the internet can be done so only through craigslist.com or govdeals.com through an account opened and maintained by the Auditor of the City;
(c) The administrators of craigslist.com or govdeals.com will determine the manner in which bids are placed, although bidding must be open for not less than fifteen days;
(d) The Auditor of the City shall set the current value of the item of property to be auctioned on the internet based on City Ordinance;
(e) The Auditor of the City shall make contact with a representative of the internet site to be used to sell said personal property, and shall contract with the representative for internet auction services, and the name and contact information of that individual will be maintained by the Auditor of the City for the public upon demand;
(f) The conditions of the sale include a price reserve, payment by credit card (Mastercard, Visa, Discover, and American Express only), cash, money order or cashier’s check only, and no current employee or officer of the City of Fostoria, Ohio shall be permitted to bid;
(g) Sales tax will apply if necessary;
(h) The winning bidder shall pick up the property from the City of Fostoria, Ohio and, upon payment, title shall be transferred, if applicable;
(i) This policy will be in effect for one-year after its effective date.
(j) This policy shall be posted at a conspicuous place in the City Municipal Building for the year it is in effect, and shall be published on the City’s website, and shall further be published in a newspaper of general circulation at least twice, wherein the second notice shall be published not less than ten nor more than twenty days after the previous notice. All publications of this policy shall include the entire resolution in its entirety.
