The following definitions shall apply only to the provisions of the Preservation and Design Review Regulations of the City Zoning Code.
(a) "Alter" or "alteration" means any exterior visual or material change to any Listed Property or property located within a Historic District. For the purposes of this chapter, "alteration," includes a change in design, texture, material, or architectural feature. Ordinary maintenance to correct any deterioration or damage is excluded from the definition of "alteration," provided such work does not involve a change in design, texture, material or architectural feature.
(b) "Applicant" means any owner, owners, person, persons, association , partnership or corporation who applies for a certificate of appropriateness in order to undertake any change on property subject to this chapter.
(c) "Change" means an alteration, demolition, removal or construction involving any property subject to the provisions of this chapter including signs.
(d) "Property" means any place, building, structure, work of art, fixture or similar object, within the district or as otherwise designated as a listed property by this Board with approval of Council, but shall not include real property unless expressly provided.
(e) "Landscaping" means or includes only such major landscaping work that is to be open tracts of land, parking lots, streets, alleys and other large open areas, but not including the planting or arrangement of flowers and plants incidental to the enhancement of single properties.
(f) "Listed Property" means any property which has special character, historical, aesthetic or architectural value as part of the heritage development or cultural characteristics of the City, State or the United States and which has been designated as a Listed Property pursuant to the provisions of the Zoning Code.
(g) "Preservation District" means any area so designated on the Zoning Map in accord with the provisions of the Zoning Code.
(h) "Member" means any member of the Review Board.
(i) "Owner" means the owner or owners of record.
(j) "Review Board" means the Design Review Board established under the provisions of this Zoning Code.
(k) "Certificate of Appropriateness" means a certificate issued by the Commission to an applicant stating that a proposed alteration, demolition or new construction to a Listed Property or within a Historic District is appropriate under the terms of this chapter.
(l) "Architectural Feature" means the architectural style, general design and general arrangement of the exterior of a building or structure including but not limited to windows, doors, porches, signage, cornices, exterior surface materials, decorative trim, and other fixtures appurtenant to the exterior of the building or structure.
(m) "Historic District" means two or more properties which are grouped together in a geographically defined area. And which as a whole have special character, historic, aesthetic or architectural value as part of the heritage, development or cultural characteristics of the City of Fostoria, State of Ohio or the United States and which has been designated as a Historic District pursuant to the provisions of this chapter.
(n) "Ordinary Maintenance" includes the repair or replacement in kind of features including but not limited to the roof, eaves, downspouts, siding, windows, and doors of a Listed Property or a property located within an Historic District providing that it does not result in a change of material, texture, or architectural feature. For the purpose of this chapter, the sand-blasting of masonry is not considered ordinary maintenance.
