133.02 EMERGENCY POWERS.
   (a)   The Mayor is granted the power to invoke by proclamation a state of emergency in the City during an energy crisis.
   (b)   The power conferred upon the Mayor shall include but not be limited to the power and authority to order the closing or the restricting of the hours of operation of all non-essential services such as all business establishments, commercial establishments, industrial centers, factories, entertainment centers, recreational facilities, schools, etc. The power and authority granted to the Mayor shall extend on a limited basis only to retail food establishments, drug stores, medical facilities, and the Fostoria City Hospital which shall be permitted to remain open.
   (c)   In the event the Mayor shall deem it necessary to issue a proclamation of a state of emergency he shall do so by issuing a detailed proclamation to the news media including newspaper, radio, and television when practical and by notification to all businesses and other establishments covered by the proclamation.
   (d)   Whoever violates any of the provisions of the proclamation issued by the Mayor under the authority of this section shall be guilty of a misdemeanor of the third degree, and each day's violation shall constitute a separate offense. (1979 Code 32.02)
