(a) Chapter 945 establishes a storm water utility, storm water rates, clean water compliance fees and service charges. Monies collected from the storm water service charges are to be utilized solely for the management of storm water. Monies collected from the clean water compliance fee are to be utilized solely for the wastewater projects required by the NPDES permit or court order.
(b) The Storm Water Management System shall promote the public health, safety and welfare and provide for the safe and efficient capture of storm water runoff; mitigation of the damaging effects of storm water runoff; address the storm water problems, funding of the activities of storm water management, planning, design, regulations, education, coordination, construction, operation, maintenance, inspection, and enforce activities related to storm water and promote the public health, safety and welfare and provide for funding of the activities of sanitary/wastewater projects, planning, design, regulations, education, coordination, construction, operation, maintenance, inspection, and enforce activities related to wastewater as required by the NPDES permit or court order. The System shall be used to establish just and equitable rates and charges to be paid to the City for the use of such services.
