(a) Every person owning property in the City abutting upon any macadamized or improved street, in front of which and between which and the curbstone there is a lawn, shall grade the lawn and set the same with grass, and shall keep the same free from weeds and rubbish. In case of failure of any owner to comply with the provisions of this section within 5 days after receiving, either by himself or agent, notice from the Zoning Inspector so to grade and care for the lawn, the grading shall be done by the Zoning Inspector, and the cost thereof shall constitute a lien upon the premises so abutting on the lawn. The lien shall be collected or enforced in the manner provided for the collection of assessments of damages and expenses for making public improvements. (Ord. 96-65. Passed 7-16-96.)
(b) (1) Every owner, occupant or person having charge of any building, lot or land abutting upon any street right of way or any public highway right of way in the City, shall grade the tree lawn or curb strip and set the same with grass, and shall keep the entire width of the tree lawn, curb strip, or public property from the street line or curb to the lot line, in good repair and free from grass exceeding a height of twelve inches.
(2) The City shall be responsible for lawn maintenance of railroad underpass areas (Mid-Block, Center St., and Lytle St.).
(3) Nothing in this subsection shall prohibit the planting of landscape plant materials or approved trees.
(4) Enforcement of this subsection shall be the responsibility of the Zoning Inspector. (Ord. 99-73. Passed 8-3-99.)
