5-9-1: DEFINITIONS:
   A.   In this chapter the following terms have the meaning indicated below:
    ACCUMULATE: To gather, collect, heap or pile up.
   COMMUNITY DECAY: A public nuisance created by allowing rubble, debris, junk, junk vehicle(s), dangerous structure(s), or refuse to accumulate on or adjacent to a public right of way so that it:
      1.   Endangers safety or health, is offensive to the senses, or obstructs the free use of property so as to interfere with the comfortable enjoyment of life or property.
      2.   Is a condition which renders dangerous for passage on any public right of way.
Community decay does not include persons servicing, manufacturing, or processing materials, goods, or products on lots in public view, so long as the materials used in the normal operation of the business are neatly stacked, piled or shredded, and such businesses are conducted within a properly zoned area. Community decay does not include normal residential maintenance or landscaping.
   PERSON: An individual, firm, partnership, company, association, corporation, city, town, local governmental entity, or any other governmental or private entity, whether organized for profit or not.
   PUBLIC NUISANCE: A nuisance which affects, at the same time, an entire community or neighborhood or any considerable number of persons, although the extent of the annoyance or damage inflicted upon individuals may be unequal.
   SHIELDING: Refers to fencing or other manmade barriers to conceal community decay from public view. It also refers to natural barriers. Any shielding barrier must conform to all local zoning, planning, building, and protective covenant provisions. Any shielding is to be of sufficient height so that none of the violations on the premises is visible to public view. This is not intended to require that permanent buildings, other structures, or utility poles be included in this and be shielded. (Ord. 2003-10, 11-10-2003, eff. 12-10-2003)
