5-4-2: DESTRUCTION OR REMOVAL OF WEEDS:
   A.   Required; Weeds Specified: Pursuant to the authority as provided by Montana Code Annotated section 7-22-4101, owners of all lots or parcels of land within the City limits, shall cause to be cut, destroyed or removed (not limited to) all dandelions, fan weed, fireweed, thistles, noxious weeds, grass and all other nonornamental vegetation over twelve inches (12") in height growing on their property (includes alleys and streets). Such owners shall be responsible for removal of those weeds after receiving reasonable notice given by either the Public Works Director or other authorized employee of the City or County.    B.   Failure To Comply; Assessment And Penalty: The City may levy the cost of weed extermination and removal and may bill or otherwise assess such cost as a special tax against the property in the event the landowner fails to satisfactorily remove the weeds within a reasonable time after notice. Violations of this chapter are designated as Municipal infractions as specified in title 1, chapter 4 of this Code. (Ord. 2018-05, 11-19-2018, eff. 1-1-2019)
   C.   Public Nuisance; Additional Sanction: In addition, failure to satisfactorily remove the weeds, within a reasonable time after notice, may be considered the maintenance of a public nuisance in violation of Montana Code Annotated section 45-8-11, and the offender will be subject to additional sanction as provided under law.
