10-2-14: EXTENSION OF SEWER DISTRICT MAINS:
   A.   Pipe Size: No sewer main line extension may be less than eight inch (8") pipe, approved by the Water/Wastewater Superintendent or Director of Public Works. (Res., 1-1-1977; amd. 1999 Code)
   B.   Frontage Requirement: Beginning at the point where service is available, the main shall be extended across the frontage of one-half (1/2) the frontal width of the property to be served, except in those locations where the City Council shall, by resolution, reduce this frontage requirement. The term "property to be served" shall mean that such extension shall abut and run one-half (1/2) the frontal length of the applicant's property, unless the City Council shall otherwise order whether one or more than one connection is to be made to the main for service to the applicant's property. Whenever the applicant shall own and intend to occupy in person or by lessee or tenant, a residence or business structure or enterprise occupying more than one lot, such sewer main extension shall extend a full one-half (1/2) the frontage length of such parcel of property to be so used or occupied, unless for good cause the City Council shall otherwise direct. The purpose of this provision shall be to make uniform and equalize, to the extent possible, costs of installation on an ownership basis. (1981)
   C.   Installation By City: All installation of sewer main extensions will be done by the City on a cost for material, plus labor cost basis. Individual contractors may not install sewer main extensions, except by express approval of the City Council for any such individual project, excepting only subdivisions, as defined by the subdivision regulation of the City and County, which said subdivision shall be excluded from the provisions of this Section, subject to subdivision regulation requirements for utility services.
   D.   Estimate Of Costs: Costs for installation shall be estimated prior to installation and payment on said estimate basis made by the applicant prior to the installation by the City. Should the actual cost and labor involved exceed the estimate, the applicant will be billed at the conclusion of installation and will thereafter be required and obligated to pay the balance due within thirty (30) days after billing. In the event of any overpayment on estimate basis, such overpayment shall be immediately refunded by the City upon completion of the project.
   E.   Lateral Connections: All lateral connection to mains installed by the City pursuant to these provisions shall be made by the owners or their contractors or employees, subject to City supervision and control.
   F.   Appurtenances: Main extensions shall include any appurtenances or controls deemed necessary by the City.
   G.   Reimbursement: For the purposes of equity, any individual property owner making a sewer main extension at his own expense, except where such main is constructed by special improvement district, shall be entitled to a pro rata reimbursement from other abutting property owners who may subsequently require a connection to the said sewer main so installed. Such connections by subsequent property owners shall be prorated on the basis of fifty foot (50') frontage per lot and the reimbursement provisions hereof shall remain in effect for ten (10) years after the installation of any sewer main extension provided for herein.    H.   Application Required: Before any person may install a sewer main extension, he must make application to the Water/Wastewater Superintendent or Director of Public Works. Under the provisions of this Section, such applicant making application within ten (10) years after extension of the sewer main by any private individual, shall be required to make payment on a proportionate basis.
   I.   Criteria For Reimbursement: Reimbursement under this Section shall be determined initially by the Water/Wastewater Superintendent or Director of Public Works, using the following criteria: (Res., 1-1-1977; amd. 1999 Code)
      1.   The total potential users of the sewer main extension shall be estimated on the basis of the most probable development of lots adjacent to the sewer main extension, the capacity of the installation and the capacity of the City sewer system.
      2.   The standard method, not to exclude other methods or factors, of estimating the number of total potential users shall be that one potential user will be allotted per fifty feet (50') of abutting lot frontage. The total potential use by the applicant shall be similarly determined and included in the total of potential users.
      3.   The cost for sewer lateral connection for private line connecting to the sewer main extension shall be found by dividing the total cost of the sewer main extension installation by the total potential users of the sewer main extension.
      4.   No person shall be reimbursed a greater amount than the total cost of the sewer main installation less that person's total potential use multiplied by the cost per private sewer service connection, as established by the City Council.
      5.   Review of the reimbursement determination may be made by the City Council upon demand.
      6.   For the purposes of administering this Section, each person, including the person extending the sewer main, shall be charged the current hook-up fee for each private sewer line connection to the main as determined by the City Council. (Res., 1-1-1977)
   J.   Applicable Codes And Rules: The size, slope, alignment, materials of construction of all sanitary sewers and sewer connections and the methods to be used in excavations, placing of the pipe, jointing, testing and backfilling the trench, shall all conform to the requirements of the building and plumbing codes or other applicable rules and regulations of the City and the State. In the absence of code provision or in amplification thereof, the materials and procedures set forth in appropriate specifications of the ASTM and WPCF Manual of Practice No. 9 shall apply.
