7-1-6: DRINKING IN PUBLIC PLACES; DISPLAY 1 :
   A.   Definitions: The following words and phrases used in this section shall be defined as follows:
    BEER: Shall mean and be defined as that term is defined in the Alcoholic Beverage Code by section 16-1-106, Montana Code Annotated, as amended.
   LIQUOR OR LIQUORS: Shall mean and be defined as those terms are defined by section 16-1-106, Montana Code Annotated, as amended, of the Alcoholic Beverage Code.
   PUBLIC DISPLAY OR EXHIBITIONISM OF BEER OR LIQUOR: The carrying and exhibiting of opened cans or bottles of beer or the carrying and exhibiting of glasses or containers containing beer or liquor, even though empty, from retail liquor or beer establishments to, in, on or upon the public places in the City, but does not include carrying or transporting such beer or liquor from retail liquor or beer establishments in sacks, cases, boxes or cartons when no display or exhibition is made.
   PUBLIC DRINKING: The drinking or consuming of beer or liquor in, on or upon the public places in the City.
   PUBLIC PLACES: The streets, avenues, alleys and places in the City, but does not include the premises licensed for the sale of liquor or beer at retail by the Montana Liquor Control Board, nor does it include private residences and other private places not within the public view.    B.   Public Drinking And Display Prohibited; Violation: "Public drinking" and "public display or exhibitionism of beer or liquor", as defined in subsection A of this section, is hereby prohibited and it shall be unlawful for any person to engage in "public drinking", as herein defined, within the City limits, and it shall be unlawful for any person to engage in "public display or exhibitionism of beer or liquor", as herein defined, within the City limits. Violations of this section shall be considered a misdemeanor and punishable as set forth in this Code. (Ord. 2018-05, 11-19-2018, eff. 1-1-2019)
