If payment of any settlement amount hereunder is not received by the village within 30 days from the date such offense was allegedly committed, or ten days prior to the listed court date of any such citation, whichever is earlier, the village may authorize the Village Attorney or his or her designee to proceed with an ordinance violation charge by filing such charge with the County Circuit Clerk’s office. In the event the village proceeds with the filing of an ordinance violation, the respondent shall be responsible for all costs to the extent permissible by law, in addition to any fine.
