3-1-11: GARBAGE AND REFUSE:
   A.   Receptacle Required: It shall be the duty of every owner or his agent or occupant of any house, building, flat or apartment, or tenement in the village where people reside, board or lodge, or where animal or vegetable matter is prepared or served, at all times to maintain in good order and repair, a separate receptacle for tin cans, bottles, ashes and similar refuse. It shall be the duty of every such occupant to deposit nothing but garbage or paper in the can provided for the same, and nothing but tin cans or bottles in the receptacles provided for the same.    B.   Specifications: The can for garbage shall be watertight and made of metal with a close fitting cover; and such can shall have a capacity of not less than ten (10) gallons nor more than fifty (50) gallons and shall be provided with suitable handles. (1970 Code §463)
   C.   Ash Cans: A receptacle for ashes, tin cans and bottles shall be either of metal, wood or cement, and such receptacle shall have a capacity of not less than ten (10) gallons. No hot ashes shall be placed in a wooden receptacle. (1970 Code §464)
   D.   Deposit In Streets: No garbage or refuse of any kind shall be deposited in any street, alley or public way, excepting as is provided in this chapter; and no such refuse shall be so placed that it can be blown about or scattered by the wind. (1970 Code §465)
   E.   Incinerators: (Rep. by Ord. 2003-06, 4-7-2003, eff. 4-17-2003)
   F.   Burning:
      1.   No person shall cause or allow the burning of garbage, refuse, leaves, grass, yard waste, twigs, tree limbs, lumber, scraps and shavings.
         a.   "Garbage" is defined under this subsection F as waste resulting from the handling, preparation, cooking and consumption of food; waste from the handling, storage and sale of produce.
         b.   "Refuse" is defined under this subsection F as combustible trash, including, but not limited to, paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, bedding; noncombustible trash, including, but not limited to, metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, other mineral waste; street rubbish, including, but not limited to, street sweepings, dirt, catch basin dirt.
      2.   Nothing contained herein shall prohibit the following acts of burning:
         a.   The burning by the village of Forreston of tree branches, limbs and trunks at the village operated burn pit.
         b.   A person shall be permitted to burn for purposes of cooking food for consumption of his or her family and guests.
         c.   Recreational fires shall be permitted provided said fires are contained in a fire safe vessel or pit not exceeding twenty four inches (24") in diameter. All recreational fires shall be extinguished by ten o'clock (10:00) P.M. No fires shall be built or lit so close to any building or other structure as to endanger such a building or structure.
         d.   Bonfires shall be permitted under the following circumstances:
            (1)   The fire is part of a community wide celebration hosted by a taxing body or local not for profit organization, and
            (2)   The fire department and police department are notified at least forty eight (48) hours in advance of said event, and
            (3)   Atmospheric or local circumstances subject to fire will not create a hazard to health or safety, and
            (4)   The fire will not be located in such a way to cause damage to buildings or other structures, public streets or sidewalks.
      3.   Any fires permitted under this subsection F shall be subject to the following:
         a.   The right of the village board of trustees to prohibit burning at any time for public health and safety reasons.
         b.   The village police department's right to prohibit, stop, cause or order any fire to be extinguished if the fire does not comply with the provisions of this subsection F, or if the police department determines that due to the size, location, wind or other atmospheric conditions, it poses a threat to the safety of persons or property.
         c.   Any permitted burning under this subsection F shall be supervised by a proper and responsible person of at least age eighteen (18). No fire shall be left unattended at any time. (Ord. 2003-04, 4-7-2003, eff. 4-17-2003)
