(A) (1) Swimming pools, within the scope of this section or not enclosed within a permanent building, shall be completely enclosed by a fence of sufficient strength to prevent access to the swimming pool and shall be not less than four feet in height, so constructed as not to have voids, holes or openings larger than four inches in one dimension.
(2) Gates or doors shall be equipped with a self-closing and self-latching device for keeping the gate or door securely closed at all times when not in actual use.
(B) Permanent access from grade to aboveground swimming pools having stationary ladders, stairs or ramps shall have not less than equal safeguard fencing and gates.
(C) A three feet exclusion zone shall be maintained between the pool and the required fence at all times.
(D) If the pool has a deck attached, the deck also is required to maintain a three feet exclusion zone from the required fence. If this cannot be achieved then, a fence not less than four feet is required on the deck.
(E) The wall of a house or building faced to a swimming pool may be incorporated as a portion of such fence.
