Any person 18 years of age or over who violates § 138.27 by delivering drug paraphernalia to a person under 19 years of age who is at least three years his junior is guilty of a special offense and on conviction is guilty of a misdemeanor of the second degree for a first offense and shall be deemed guilty of a misdemeanor of the first degree for a second or subsequent offense.
