§ 138.02 APPLICATION OF PROVISIONS.
   (A)   Any person having previously been convicted of a gambling offense under this code or the Revised Code, shall, on a subsequent offense, be prosecuted pursuant to the pertinent provisions of R.C. Title 29.
   (B)   This section shall not apply to § 138.05.
