(A) All fares and charges for the use of an auto for hire shall be determined by the hourly rates specified below. The hourly rate shall not exceed the following schedule.
(1) For a car seating five persons or less, $3 per hour, irrespective of the number of persons carried.
(2) For a car seating six persons or more, $4 per hour, irrespective of the number of persons carried.
(B) The rate for a car seating six persons or more shall apply only in case the passenger expressly specified and ordered such a car.
