§ 96.38 PERMIT REQUIREMENTS.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CITY. The City of Forest Park, Ohio.
   COLLECTION AGENTS. Any owner of collection and transportation vehicles used for the purpose of collection and disposal of residential and commercial solid waste including, but not limited to, garbage, refuse and recyclables.
   COMMERCIAL. Any structure, whether public or private, that is adapted for transaction of business, for rendering professional service, for amusement, for the display, sale, or storage of goods, wares or merchandise or for the performance of work or labor, including hotels, office buildings, public buildings, stores, theaters, markets, restaurants, warehouses, factories, and other structures on premises used for business purposes.
   CURBSIDE. The land area that lies adjacent to a public street, typically the area between the public sidewalk and the curb or pavement of a public street.
   RECYCLABLES. Any materials removed from the solid waste stream for purposes of reprocessing and/or reuse. Such items include, but are not limited to, newsprint, glass, metals, plastics, and corrugated cardboard.
   RECYCLING DROP-OFF CENTER. Any entity, public or private, whose primary business is the operation of a facility for the public to bring and drop off recyclables.
   REFUSE. Nonputrescible nonliquid wastes such as ashes, cinders, rags, wood, large household objects, paper boxes (not including corrugated cardboard), bricks, concrete, plaster or other items from construction, remodeling or repairing or grounds.
   RESIDENTIAL. Any single/dual and multi-family dwellings.
      (1)    SINGLE/DUAL FAMILY RESIDENTIAL. A freestanding dwelling unit located on its own lot designed to be occupied by one or two families.
      (2)    MULTI-FAMILY RESIDENTIAL. Three or more dwelling units located within a single building. A multi-family residential development may contain one or multiple buildings. A multi-family development may include, but is not limited to the following building types: garden apartments, town homes, and patio homes.
   (B)   Rules and regulations.
      (1)   No person or entity shall engage in the business of operating a recycling drop-off center nor the business of hauling garbage, refuse or recyclables within the corporation limits of the city unless he/she shall first obtain a permit therefor from the City Manager. Any tax exempt charitable business is excluded from having to purchase a permit.
      (2)   The City Manager shall collect an annual fee of $100 for each permit issued, which fee shall be for the calendar year for which the permit is issued.
      (3)   Collection agents and recycling drop-off centers shall supply the City Manager with complete copies of all reports required by the Hamilton County Solid Waste Management District which identifies the tonnage of recyclables collected and the tonnage of solid waste landfilled. These reports shall be mailed to the City Manager on the date the reports are mailed to the Hamilton County Solid Waste Management District.
      (4)   Collection agents shall begin collection services no sooner than 6:00 a.m. and end when the collection route is completed.
      (5)   Collection agents shall provide, unless refused by written notice, all of their curbside customers or subscribers with curbside recycling and collection services. These curbside recycling services shall include the provision of suitable containers to each single, dual, or multi-family residential customer or subscriber. The cost of these curbside recycling services will be included in the customer's or subscriber's solid waste collection cost.
      (6)   Recycling and collection services for non-curbside, multi-family residential customers/subscribers shall be provided by the collection agent unless refused by written notice by the multi-family dwelling's manager/owner. The cost for these non-curbside recycling services may be separate or in addition to the base costs charged for refuse collection. The collection agents shall also promote recycling and develop environmental awareness materials specifically for these customers/subscribers.
      (7)   Collection agents shall promote recycling and collection services for non-curbside commercial customers/subscribers and shall also develop environmental awareness specifically for these customers/subscribers.
      (8)   Each collection agent shall comply with the Hamilton County Solid Waste Management Plan. Each collection agent shall participate in and provide educational materials and training programs for residents and businesses of the city for the purpose of promoting voluntary recycling. These programs shall include, but not be limited to:
         (a)   Distributing annual newsletters to their customers or subscribers summarizing but not limited to the reports submitted to the Hamilton County Solid Waste Management District;
         (b)   Participating in an initial community information meeting, as organized by the city, to describe their refuse collection and recycling program;
         (c)   Cooperating with school and classroom presentations as required;
         (d)   Providing field trips to their recycling and landfill facilities as requested by a recognized community organization;
         (e)   Providing and distributing to their customers or subscribers up-to-date fliers/brochures describing in detail what the procedures are for collection of garbage, refuse and recyclable materials and how materials should be prepared. The fliers/brochures shall be updated and distributed to their customers or subscribers whenever there are significant changes in the garbage/refuse collection and/or recycling services. Any new customer or subscriber shall be provided an initial up-to-date flier/brochure.
         (f)   Providing and distributing to their customer's environmental awareness materials, approved by the City Environmental Awareness Program Director, with each customer billing or by other direct mail methods, no less than four times per year.
      (9)   Any recycling drop-off center shall cooperate with the city in promoting and developing environmental awareness materials and programs for residents and business of the city.
   (C)   Whoever violates this section is guilty of a minor misdemeanor. If the offender persists, after reasonable warning or request to desist, the offender is guilty of a misdemeanor of the fourth degree; on a second offense within one year after the first offense, such offender is guilty of a misdemeanor of the fourth degree; and on each subsequent offense within one year after the first offense, such offender if guilty of a misdemeanor of the first degree.
