(A) The city will notify the residents of the city of its support for the recycling efforts of private entities providing curbside, drop-off and/or buy-back recycling opportunities to the residents, businesses and industries of the city.
(B) No private entity shall provide, or participate in, curbside, drop-off and/or buy-back recycling opportunity within the corporation limits of the city to residences, one or more individuals, businesses and/or industries without:
(1) Compliance with the Hamilton County Solid Waste Management Plan.
(2) Distribution of educational literature approved by the city to its customers.
(3) Possession of an annual permit issued by the City Manager.
(C) Penalties. Whoever violates this section is guilty of a minor misdemeanor. If the offender persists, after reasonable warning or request to desist, said offender is guilty of a misdemeanor of the fourth degree; on a second offense within one year after the first offense, such offender is guilty of a misdemeanor of the fourth degree; and on each subsequent offense within one year after the first offense, such offender is guilty of a misdemeanor of the first degree.
