For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
AUTHORIZED PRIVATE RECEPTACLE. A litter storage and collection receptacle which is so constructed as to prevent any of its contents from being blown or deposited upon any public or private property.
COMMERCIAL HANDBILL. Any printed or written matter, any sample or device, circular, leaflet, pamphlet, paper, booklet, or any other printed or otherwise reproduced original or copies of any matter or literature which:
(1) Advertises for sale any merchandise, product, commodity, or thing; or
(2) Directs attention to any business, mercantile, or commercial establishment, or other activity, for the purpose of either directly or indirectly promoting the interest thereof by sales; or
(3) Directs attention to or advertises any meeting, theatrical performance, exhibition, or event of any kind, for which an admission fee is charged for the purpose of private use or profit. The terms of this definition shall not apply where an admission fee is charged or a collection is taken up solely for the purpose of defraying the expenses incident to such meeting, the actual performance, exhibition, or event of any kind, being given or taking place in connection with the dissemination of information which is not restricted under the ordinary rules of decency, good morals, public peace, safety, and good order. However, nothing contained in this clause shall be deemed to authorize the holding, giving, or taking place of any meeting, theatrical performance, exhibition, or event of any kind, without a license, where such license may be required by law of this state, or under any ordinance of this city; or
(4) While containing reading matter other than advertising matter, is predominately and essentially an advertisement, and is distributed or circulated for advertising purposes, or for the private benefit and gain of any person so engaged as advertiser or distributor.
GARBAGE. Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking, and consumption of food.
JUNK. Any worn-out, castoff, or discarded article or material which is ready for destruction or has been collected or stored for salvage or conversion to some other use. Any article of material which, unaltered or unchanged and without further reconditioning, can be used for its original purpose as readily as when new, shall not be considered JUNK.
LITTER. Garbage, refuse, junk, and rubbish, as defined herein, and all other waste material which, if thrown or deposited as herein prohibited, tends to create a danger to public health, safety, and welfare.
NEWSPAPER. Any newspaper of general circulation as defined by general law, any newspaper duly entered with the Post Office Department of the United States in accordance with federal statute or regulation, and any newspaper filed and recorded with any recording officer as provided by general law, and, in addition thereto, shall mean and include any periodical or current magazine regularly published with not less than four issues per year.
NONCOMMERCIAL HANDBILL. Any printed or written matter, any sample or device, circular, leaflet, pamphlet, newspaper, magazine, paper, booklet, or any other printed or otherwise reproduced original or copies of any matter of literature not included in the aforesaid definitions of a commercial handbill or newspaper.
PARK. A park, reservation, playground, or any other public area in the city, owned or used by the city and devoted to active or passive recreation.
PRIVATE PREMISES. Any dwelling, house, building, or other structure, designated or used wholly or in part for private purposes, whether inhabited or temporarily or continuously uninhabited or vacant, and shall include any yard, grounds, walk, driveway, porch, steps, vestibule, or mailbox belonging or appurtenant to such dwelling, house, building, or other structure.
PUBLIC PLACE. Any and all streets, sidewalks, boulevards, alleys, accepted rights-of-way, or other public ways, any and all public parks, squares, spaces, grounds, and buildings, and any private property to which members of the public are customarily and regularly invited or which is frequented by members of the public on a regular basis.
REFUSE. All putrescible and nonputrescible solid wastes (except body wastes), including but not limited to garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles, and solid market and industrial wastes.
RUBBISH. Nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as, but not limited to, paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, bedding, crockery, and similar materials.
