§ 73.16 PARKING IN FIRE LANES ON PRIVATE PROPERTY.
   (A)   No vehicle shall be parked in any duly established fire lane on public or private property.
   (B)   The City Manager, upon recommendation of the Police Chief or of the Fire Chief, may establish fire lanes on public or private property frequented by the public or to which property the public expressly or by implication is invited for the mutual benefit of the property owner, his lessees, and the invitees. Such fire lanes shall be limited to the areas proximate to buildings on such property and shall be necessary to provide access to the buildings on the property by public safety vehicles and equipment or by authorized emergency vehicles. The type of property upon which such fire lanes may be established shall be property upon which schools, commercial, office, or industrial buildings are erected.
   (C)   The City Manager shall by certified mail, return receipt requested, notify the owner or occupant or lessee of the school, commercial, office, or industrial property of the establishment of such a fire lane and shall also file a report of such establishment with the City Council at the next regularly scheduled meeting thereof. The owner, occupant, or lessee of any such property upon which the City Manager has established a fire lane may within 14 days after receipt of notice of establishment file an appeal with the City Council for review of such action of the City Manager. The appeal shall include the reasons for objecting to the proposed fire lane and may include an alternate fire lane proposal. City Council shall by resolution within two meetings after receipt of the appeal, affirm, deny, or modify the establishment by the City Manager of the proposed fire lanes. Failure to appeal within the 14-day period shall cause the establishment of such fire lane by the City Manager to become effective 45 days after receipt of the notice of establishment of, or if an appeal is taken from such establishment by the City Manager and the City Council affirms or modifies such establishment, the effective date thereof shall be 45 days after such City Council action.
   (D)   The owner of the property upon which the fire lane is established shall, at his own expense, and within the 45-day period, provide and install appropriate signs and markings indicating the existence of such lane or lanes, and failure to do so shall be an offense punishable by a fine not to exceed $100 for each day after the 45-day period during which such signs and markings are not provided.
