§ 36.115 GROUNDS FOR DISMISSAL.
   Any employee may be dismissed when proven guilty of any act set forth in the applicable sections of the Ohio Revised Code, the City of Forest Park Code of Ordinances, and/or any other federal or state law, or he/she may be dismissed in consequence of an accumulation of acts of lesser consequence, pointing to the desirability of his/her removal.
   (A)   The failure of an employee to pay or adjust his/her private financial obligations, after being given an opportunity to do so by cooperation with the proper authorities, shall constitute a failure of good behavior for which he/she may be dismissed.
   (B)   Any employee who is absent from duty without permission is guilty of neglect of duty or insubordination and may be dismissed.
   (C)   Absence from duty by an employee for three (3) consecutive working days without an explanation within that period, or his/her failure to return from leave of absence after the leave has expired or been revoked, shall in each case be deemed a resignation.
   (D)   If, within ten (10) days after the last day of actual work, the employee shall furnish to the appointing authority a satisfactory explanation of his/her absence, the entry of resignation may, on recommendation of the appointing authority and with the approval of the Commission, be set aside.
