§ 36.04 AFFIRMATIVE ACTION POLICY.
   (A)   It is the policy of the city to develop and maintain an affirmative action program designed to provide and promote equal opportunity for all employees and applicants without regard to race, color, religion, sex, age or national origin.
   (B)   It is the policy of the city to comply with all federal and state laws regarding discriminatory practices in recruiting, selection, promotion, compensation, and other conditions of employment, except where age or sex are essential bona fide occupational requirements.
   (C)   It is the policy of the city to require parties contracting with the city to participate along with the city in furthering equal employment opportunity.
   (D)   The Human Resources Director is designated as the equal employment opportunity officer of the city with the responsibility to develop a plan, with the concurrence of City Council, implement and monitor a program to ensure compliance with this section. He/she shall develop criteria so as to measure the effectiveness and results of the program and shall report these results to the City Council annually. He/she shall further ensure that the purpose and scope of this section is appropriately communicated and uniformly applied throughout all agencies of the city.
