(a) “Person” means a human being, or legal entity recognized by law.
(b) “Knowingly” means a person acts knowingly, regardless of his purpose, when he is aware that his conduct will cause a certain result or will probably be of a certain nature. A person has knowledge of circumstances when he is aware that such circumstances probably exist.
(c) “Dwelling house” means a building, trailer, mobile home, or a place of residence, habitation, domicile or mansion; a building for the habitation of a man; a building designed to be occupied as a place of abode; a building occupied or intended to be occupied as a residence. This definition embraces the dwelling itself and such buildings as are used in connection with it or located on the same real property.
(d) “Casual” means occurring two times or less in a given calendar year coming without regularity.
(e) “Regularly” means occurring greater than two times. Also, in a manner, way, or method which implies uniformity, continuity, consistency, and which would exclude the idea of incidental.
(f) “Established retail business” means a business that is permanent, fixed, stable, and lasting. It does not include activities conducted inside buildings, portions of buildings, dwelling houses whose set-up, holding, out to the public or appearances are stopped, torn down, removed, or materially changed overnight or a short period of time. This type of business is operated for profit during all working days of the year and all seasons of the year.
(g) “ Instrument facilitating” includes but is not limited to chairs, tables, sawhorses with boards across the top, boxes, shelves, motor vehicles or other personal property which is used to hold or store items of merchandise for sale to the general public.
