§ 34.36  INMATE PROCESSING FEE.
   (A)   There is hereby created and imposed an inmate processing fee of $25, to be collected by the County Sheriff from each detainee admitted to the county jail, with the exception of any detainee which the County Sheriff shall determine to be indigent and unable to pay same.
   (B)   The processing fee shall be collected from an inmate prior to his or her release from the facility, and shall be deducted from the inmate’s commissary account, or withheld from such other funds or monies as may be in the possession of the inmate at the time of his or her admission to the facility.
   (C)   All fees collected by the County Sheriff pursuant to this section shall be deposited in a non-reverting fund to be known as the Inmate Processing Fund, which Fund shall be used to defray expenses incurred, or to be incurred, by the County Sheriff in the purchase of equipment, vehicles, and related property for use in the operation of the county jail or the Department.
   (D)   All expenditures from the Inmate Processing Fund shall be subject to appropriation by the County Council upon petition by the County Sheriff or the Board of Commissioners.
