§ 91.12 RIGHT OF ENTRY.
   The town shall adopt from time to time the most appropriate version of the Uniform Fire Code and the Fire and Medical Department of the town, under the supervision of the Fire Chief, with or without the assistance of the town’s building and code enforcement officer, shall whenever necessary, make an inspection to enforce any of the provisions of the Uniform Fire Code. Whenever the Chief has reasonable cause to believe that there exists in any building or upon any premises any condition which makes the building or premises unsafe, the Chief is authorized to enter the building or premises at all reasonable times to inspect the same or to perform any duty authorized by the Uniform Fire Code. Provided however, that if the building or premises is occupied, the Chief shall first present credentials and demand entry, and if refused shall secure a warrant and if the building or premises is unoccupied, the Chief shall first make a reasonable effort to locate the owner or other persons having charge or control of the building or premises and demand entry or in the alternative secure a warrant.
