§ 70.10 LEAVING VEHICLE UNATTENDED WITH ENGINE IN OPERATION.
   (A)   It shall be a violation for any person, firm or corporation operating or being responsible for the operation of any automobile, truck or other motor vehicle to permit same to stand unattended upon any public street or public way within the city or upon any place accessible to the public within the city with the engine in operation for a period of more than three minutes.
      (1)   This section shall not apply to any automobile, truck or other motor vehicle left standing an the property of a truckstop. As used herein, the word "TRUCKSTOP" shall mean an establishment which sells fuel for tractor-trailer trucks; and has repair facilities for tractor-trailer trucks; and has parking spaces for more than 20 tractor-trailer trucks; and is primarily in the business of fueling, repairing and servicing tractor-trailer trucks.
      (2)   This section shall not apply to automobiles, trucks or other motor vehicles, the operators of which are engaged in making deliveries or rendering services; which are police or emergency vehicles; which are owned or operated by the Commonwealth of Kentucky, a city or county, or a public utility; or any contractor while engaged in the repair, maintenance or construction of streets, street improvements or utilities within the city.
   (B)   A penalty is hereby imposed for any violation of this section in the form of a fine of $30 for each such violation.
