§ 70.06 PARKING IN DESIGNATED HANDICAPPED AREA; SIGNAGE REQUIREMENTS FOR DESIGNATED HANDICAPPED PARKING SPACES.
   (A)   No person shall park in a designated handicapped parking area a motor vehicle not displaying either a handicapped auto registration plate as provided in KRS 186.042 or an out-of-state handicapped registration plate on the rear of the vehicle unless he displays on the rear view mirror of his motor vehicle a special parking permit issued to the handicapped as provided in KRS 189.456. No person shall park a vehicle displaying a special parking permit in a designated handicapped parking area when the vehicle is not being used for the benefit of a handicapped person. (Ord.    (B)   All designated handicapped parking spaces in the city shall be marked by standing signs meeting the specifications set forth in division (B)(1) hereof and it shall be the responsibility of the owner of the premises on which such parking spaces are located to provide the required signage.
      (1)   The signs marking designated parking spaces shall be constructed to comply with the following specifications:
         (a)   Signs shall display the International Symbol of Accessibility.
         (b)   Signs shall have light letters on dark background (preferably white on blue).
         (c)   Signs shall be erected in a permanent manner at a minimum of 40 inches above the ground for each parking space.
         (d)   Signs may either be wood or metal.
         (e)   Signs shall be a minimum of 12 inches by 18 inches.
         (f)   Signs shall conform to Chapter 11 of the 1988 Kentucky Building Code.
      (2)   Standing signs designating parking spaces which are in existence on the effective date of this division (B) shall be considered in compliance with the provisions of this division (B) if the Chief of Police makes a determination that such signs accomplish the intent of this division (B) as expressed in the preamble to Ordinance 0-21-88.
      (3)   All signs required by this division (B) shall be constructed and in place by March 1, 2004.
      (4)   Any person, firm or corporation found guilty of violating the provisions of this division shall be subject to the penalty provisions of § 70.99.
      (5)   All violations of this chapter are designated as civil offense and enforced by imposing civil fines as set out in § 33.70 et seq. The city Code Enforcement Board shall have the power to issue remedial orders and impose civil fines to enforce this code.
