§ 50.306 OTHER REMEDIES.
   (A)   If any person or other entity or user is found to be violating any provision of this chapter, the Water and Sewer Commission or the Sanitation District No. 1 may:
      (1)   Seek enforcement and require conformity to the rules and regulations of this chapter by mandamus or otherwise;
      (2)   Remove any improper construction, including connection, or close any connections made improperly or in violation of the rules and regulations or provisions of this chapter;
      (3)   Revoke any permit issued pursuant to the provisions of this chapter;
      (4)   Recover by civil or criminal action, or any other appropriate action, from any person, other entity or user, violating any rule, regulation, or standard or provision of this chapter a sum not less than $100 nor more than $5,000 for each offense, violation, or nonconformity, together with costs.
   (B)   Installation of any facility, or part thereof, by any person, other entity, or user contrary to the provisions of this chapter shall constitute a nuisance and shall be abated by injunction or other proper action upon proper application by anyone aggrieved, including the Water and Sewer Commission, Sanitation District No. 1, the Commissioner, the State Board of Health, or the County Board of Health, or other government agency, state or federal, having jurisdiction.
   (C)   Any person, other entity, or user found to be operating in violation of the provisions of this chapter shall be compelled by injunction or other proper action to cease and desist upon proper application by anyone aggrieved, including the Water and Sewer Commission, the Sanitation District No. 1, the Commissioner, the State Board of Health, or the County Board of Health, or other government agencies, state or federal, having jurisdiction.
   (D)   Any person, other entity, or user willfully failing to comply with the provisions of this chapter shall be liable for damages caused by such failure and for the cost of renewing any construction damaged or destroyed, or punitive damages as may be found proper or appropriate.
