§ 50.165 WASTEWATER DISCHARGE PERMITS.
   (A)   All major contributing industries must have prior approval from the Sanitation District No. 1 of Campbell and Kenton Counties. No statement contained in this subchapter shall be construed as preventing any special agreement or arrangements between the Water and Sewer Commission and the Sanitation District No. 1 of Campbell and Kenton Counties and any person whereby an industrial waste of unusual strength or character may be accepted by the District and by the Water and Sewer Commission for transportation or treatment subject to payment therefor. The pretreatment requirements for incompatible pollutants by industrial users shall be determined by the Campbell and Kenton Sanitation District No. 1.
   (B)   All major contributing industries proposing to directly or indirectly connect to or discharge into the wastewater treatment system shall obtain a wastewater discharge permit before connecting to or discharging into the same. All existing major contributing industries directly or indirectly connected to or discharging into the wastewater treatment system must apply for a wastewater discharge permit within 90 days after the effective date of this chapter.
   (C)   Users seeking a wastewater discharge permit shall complete and file with the Commission, an application in the form prescribed by the General Manager and the General Manager of District No. 1, and accompanied by the applicable fees. Except as otherwise agreed in writing by the General Manager and the General Manager of District No. 1, the applicant shall submit, in units and terms appropriate for evaluation, the following information:
      (1)   Name, address, and SIC number of applicant.
      (2)   Volume of wastewater to be discharged.
      (3)   Wastewater constituents and characteristics including Biochemical Oxygen Demand, Suspended Solids, pH, Phosphorus and others as required by the General Manager and the General Manager of District No. 1.
      (4)   Time and duration of discharge.
      (5)   Average and 30-minute peak wastewater flow rates, including daily, monthly, and seasonal variations, if any.
      (6)   Ground plan or plat sufficient to indicate locations of building sewers, building drains, process waste sewers, monitoring facilities, and pretreatment facilities with respect to buildings, property lines, street sewers, and industrial process facilities.
      (7)   Description of activities, facilities, and plant processes on the premises including all materials and types of materials which are or could be discharged.
      (8)   Each product produced by type, amount, and rate of production when required to determine compliance with pretreatment standards.
      (9)   Number and type of employees and hours of work.
       (10)    Any other information as may be deemed by the General Manager and the General Manager of District No. 1, to be necessary to evaluate the permit application.
   (D)   The District will evaluate the data furnished by the user and may require additional information. After evaluation of the data furnished, the General Manager and the General Manager of District No. 1, may issue a wastewater discharge permit subject to terms and conditions provided herein.
   (E)   Wastewater discharge permits shall be expressly subject to all provisions of this chapter. Permits shall contain any or all of the following:
      (1)   The average and maximum wastewater constituents and characteristics.
      (2)   Limits on rate and time of discharge and requirements for flow regulations and equalization.
      (3)   Requirements for installation of inspection and sampling facilities.
      (4)   Pretreatment requirements.
      (5)   Specifications for monitoring programs which may include sampling locations, frequency and methods of sampling, number, types, and standards for tests and reporting schedule.
      (6)   Requirements for submission of technical reports or discharge reports.
      (7)   Requirements for maintaining plant records relating to wastewater discharge as specified by the General Manager and the General Manager of District No. 1, and affording the Commission access thereto.
      (8)   Mean and maximum mass emission rates, or other appropriate limits when incompatible pollutants are proposed or present in the user's wastewater discharge.
      (9)   Additional requirements as determined by the General Manager and the General Manager of District No. 1.
   (F)   Permits shall be issued for a specified period of time but in no event shall a permit extend beyond three years of the date of issuance. Thirty days prior to the expiration of the permit, the user shall apply to the Commission for a renewal of the permit.
   (G)   The user shall be notified in writing of any proposed changes in his permit at least 30 days prior to the effective date of change. The notice shall include a specified time schedule for compliance. This time schedule shall be based on practical delivery and construction time requirements, and shall become part of the permit.
   (H)   A wastewater discharge permit is issued to a specific user for a specific operation. A wastewater discharge permit shall not be reassigned, transferred, or sold to a new owner, or significantly changed operation.
